Your Confidentiality Rights
As a licensed mental health practice in New Jersey, MVCG Psychotherapy Services is bound by some of the strongest confidentiality protections in the country. Your conversations, records, and any information shared during the course of your care are legally protected and will not be disclosed without your explicit written consent.
We are a fully HIPAA compliant practice. Under federal law you have the right to:
- Receive a copy of your health records
- Request corrections to your records
- Know how your information is used and shared
- Request restrictions on how your information is disclosed
- Receive a formal Notice of Privacy Practices
- File a complaint if you believe your privacy rights have been violated
Your psychotherapy notes receive special protection under HIPAA, above and beyond standard health records, and may not be shared without your explicit written authorization in most circumstances.
We do not sell your data. We do not share your information for marketing purposes. We do not disclose your information to employers, family members, or third parties without your consent except as required by law.
Limited Exceptions to Confidentiality
Confidentiality is not absolute. There are specific, legally defined circumstances under which information may be shared without your consent:
- Imminent safety concerns: If there is a serious and credible risk of harm to you or an identifiable third party we may be required to take protective action under New Jersey's duty to warn law
- Mandatory reporting: New Jersey law requires reporting of suspected abuse or neglect of children, elderly individuals, or vulnerable adults
- Court orders: We may be required to disclose information in response to a valid court order or subpoena
- Medical emergencies: In a life threatening emergency your information may be shared with emergency medical personnel
- Insurance billing: We share the minimum necessary information with your insurance provider to process claims
Your therapist will discuss these limitations with you fully during your first session.
Telehealth Privacy
All telehealth sessions are conducted through a secure, HIPAA compliant platform. Sessions are never recorded without your explicit consent. We recommend ensuring you are in a private location during telehealth sessions to protect your confidentiality on your end.
